Moodle application software and related intellectual property is owned
by Moodle.
You may access, use, and benefit from PQA's Moodle website, and from any or all of the intellectual property owned by
PQA that
is displayed on PQA's Moodle website, provided that all of the following conditions
are met on an on-going basis:
- The downloading of one or more files, images,
intellectual property, or other
items from PQA's Moodle website (http://www.pqa.net/moodle), and/or
the possession, control, use, retention, or benefiting from one or more of these
items are subject to PQA's Copyright License.
- Prior to uploading or creating
of any document on PQA's Moodle website, you are responsible for obtaining
permission from the copyright owner.
- If you are the creator or owner of
copyrighted items, by uploading or creating one or more items on PQA's
Moodle website, you automatically provide PQA with a non-cancelable
copyright license and moral rights for these items for free. PQA may make
copies, use, and retain those items in any manner, for any purpose.
PQA can create derivatives, and is sole owner and creator of any
derivatives that PQA may create.
- You will not use any
concepts, methods, materials, intellectual property, or other items that
are on (or derived from) PQA's
Moodle website to compete against PQA, nor
against PQA's best interests.
- You will only
perform those actions on this site that you are expressly permitted to do,
and use this site only for PQA's intended purposes.
You will act in a legal, moral, co-operative, and friendly manner while on
the site, and towards all other users of the site. You will perform all tasks that you are responsible for in a timely, effective,
and professional manner. You will pay for all goods and services that you use or
benefit from. You will not attempt to circumvent the website's terms,
requirements, and protections; nor directly, indirectly, or inadvertently
aid or permit others to do so.
- If you
are alleged to have breached any of these terms, then using your best
efforts you will aid PQA to investigate and/or correct the problem
and all subsequent consequences. If you are
subsequently found to have breached any of these terms, been negligent, or
are similarly responsible for damages or losses incurred, you will
indemnify and hold PQA harmless (including PQA's legal
defense), and fairly compensate any third
parties who are adversely affected by your actions and inactions.
- These terms are subject to change, cancellation and/or revocation at any time
by PQA providing public notice
thereof through this website. PQA does not require any justification, just cause, prior warning, notice period, nor
is there any additional
requirement to notify you nor other persons of any change, cancelation, or
revocation.
- These terms will be interpreted (and will be deemed to have been entered into,
delivered, and agreed upon) under the laws and jurisdiction applicable to
London, ON Canada; except that the provisions for any conflicts with the laws in
other jurisdictions shall not apply. All other laws and legal principles
(whether domestic, foreign, international, or treaties) which are more
rigorous or restrictive on PQA, or less rigorous or less
restrictive on you are hereby opted out of, exempt from, and of
no effect. All disputes directly or indirectly related to these
terms will be
filed, heard, and decided by the courts of competent jurisdiction located
in London ON Canada; or if PQA expressly agrees in writing or
decides, another jurisdiction.
